Effective October 21, 2026 · Version 1.1
These Terms of Use (the “Terms”) govern your access to and use of Capza, a product operated by Level Up Residential LLC (“Capza,” “we,” “us,” or “our”). By creating an account, affirmatively accepting these Terms, purchasing a subscription, or otherwise using Capza, you agree to these Terms.
Capza is intended for adults. You must be at least 18 years old and legally capable of entering into a binding agreement to create an account.
Capza is currently intended for users in the United States.
Capza is a residential property ownership and continuity platform that helps owners organize information about a property, plan for future capital needs, preserve property history, and maintain supporting records.
Capza may provide lifecycle estimates, planning dates, reserve calculations, projected replacement costs, preparedness indicators, reports, historical records, and other informational tools.
Capza is not a budgeting service, bank, investment adviser, financial adviser, tax adviser, insurance adviser, attorney, home inspector, engineer, contractor, broker, appraiser, title company, or certification service.
You are responsible for maintaining accurate account information, safeguarding access to your account, and promptly notifying us of suspected unauthorized access.
You may not share credentials in a manner that defeats Capza's permission system or allow another person to impersonate you.
Capza helps preserve and organize information and records relating to a property. Current record information may come from you, documents and photographs you provide, or calculations and organization performed by Capza using information you provide.
You remain responsible for reviewing, correcting where appropriate, and accepting information that becomes part of your Ownership Record. Information does not become independently verified, inspected, certified, endorsed, authenticated, or guaranteed by Capza merely because Capza stores, organizes, displays, extracts from, or calculates using it.
Capza may preserve source information associated with a record. Accepting a historical entry does not mean that you personally witnessed the underlying event.
Capza's lifecycle dates, useful-life assumptions, replacement timing, projected costs, reserve calculations, reserve suggestions, preparedness indicators, inflation assumptions, contingencies, and similar outputs are estimates and planning tools.
Actual system condition, failure timing, repair or replacement decisions, and costs can differ materially. Outputs may depend on incomplete or inaccurate user inputs and generalized assumptions.
You are responsible for actual property, financial, repair, replacement, and purchasing decisions.
Capza may help you preserve records that could be useful in connection with taxes, insurance claims, warranties, resale, contractor disputes, financing, or other matters. Capza does not provide tax, legal, accounting, insurance, investment, appraisal, inspection, engineering, title, or contractor services and does not guarantee:
You retain your rights in information, documents, photographs, notes, and other content you submit to Capza (“User Content”), subject to any rights held by third parties.
You grant Level Up Residential LLC a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, format, back up, and otherwise use User Content as reasonably necessary to operate, secure, maintain, improve, and provide Capza and the features you choose to use.
This license does not transfer ownership of your User Content to Capza.
You represent that you have the rights and permissions reasonably necessary to submit User Content and authorize the uses described in these Terms.
Property records may contain information about other people, contractors, insurers, prior owners, or service providers. Do not submit information you are not legally permitted to provide.
Avoid uploading unnecessary Social Security numbers, passwords, full payment-card credentials, full financial-account credentials, or other information Capza does not need.
You are responsible for keeping independent copies of any records you consider essential. Although Capza uses systems designed to preserve your records, no online service can guarantee permanent availability or recovery of every file in every circumstance.
Capza currently offers Free and Pro access. Feature availability may differ by plan.
Current product model:
If a Pro account downgrades to Free, access may change while eligible records remain preserved and may become locked under the Free plan. Downgrading to Free is not the same as deleting your Capza account or data.
Capza Pro is offered as a recurring subscription. The applicable price, billing frequency, automatic-renewal terms, and method for stopping future renewal charges are shown before purchase.
Prices are shown before taxes. Applicable sales, use, value-added, or similar taxes, if any, are calculated based on your billing address and added at checkout and on applicable renewals.
Unless the offer states otherwise, a paid subscription renews automatically at the disclosed interval until you stop the paid renewal by downgrading to Free.
You authorize the disclosed recurring charges when you affirmatively accept the subscription disclosure and continue to purchase.
To manage your paid plan, select Change Plan in Account Settings. This opens Stripe's secure Customer Portal, where you can manage your subscription and downgrade to Free. To avoid the next renewal charge, complete the downgrade before the next renewal date shown in the Stripe Customer Portal. The Portal will show the effective timing of the plan change.
Downgrading to Free stops future Pro renewal charges according to the timing shown in the Stripe Customer Portal. It does not delete your Capza account, Ownership Record, documents, or photos.
Except where required by applicable law or expressly stated otherwise, subscription fees already charged are non-refundable and we do not provide credits for partially used billing periods.
Capza will provide subscription confirmations, renewal or material-change notices, and other subscription communications as required by applicable law.
Payments are processed by Stripe. Capza does not collect or store full payment-card numbers in its application.
Your payment activity may also be subject to Stripe's applicable terms and privacy practices. You are responsible for maintaining current billing information with Stripe.
If a payment fails, your Pro access may continue temporarily or change based on Stripe's billing and retry status. We may limit or end paid access after an unresolved failed payment, subject to applicable law.
Capza relies on third-party providers for services including authentication, hosting, database and file infrastructure, email delivery, and payment processing.
Third-party services may be governed by their own terms and privacy practices. We are not responsible for outages, acts, or omissions of third-party providers outside our reasonable control.
You may not:
Capza, its software, design, text, graphics, logos, trademarks, and other materials are owned by Level Up Residential LLC or its licensors, excluding User Content.
These Terms give you a limited, revocable, non-transferable right to use Capza for its intended purposes while your account is authorized.
If you voluntarily provide product feedback or suggestions, you permit us to use them without restriction or compensation, provided we do not publicly attribute private feedback to you without permission.
We may update, improve, add, remove, or modify features. We do not guarantee uninterrupted or error-free availability.
Material changes affecting subscriptions, privacy, or contractual rights will be handled according to applicable law and the relevant notice or consent requirements.
We may suspend or terminate access when reasonably necessary to protect Capza, users, or third parties; respond to unlawful use; address fraud or security risk; or enforce these Terms.
Suspension or termination of access is separate from user-requested account deletion.
You may request permanent deletion from the Delete Account section in Account Settings.
Submitting a deletion request does not immediately delete your account. We use a confirmation and review process designed to help ensure that a deletion request came from the authenticated account holder and to complete deletion consistently across Capza's systems.
Once an approved deletion is completed, your Capza account and associated property records, documents, photos, and other account data scheduled for deletion cannot be recovered. Before requesting deletion, save anything you want to keep.
We may retain a limited deletion-authorization record, including account identifiers, the acknowledgement you accepted, the date and time of the request, technical information associated with the request, and completion status, for security, fraud prevention, recordkeeping, and dispute purposes. We may also retain information when required or permitted by law, and data may remain for a limited period in normal provider backup cycles.
Deleting your account also ends any active Pro subscription as part of the deletion process. Downgrading to Free does not delete your account or records.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPZA IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. LEVEL UP RESIDENTIAL LLC DISCLAIMS WARRANTIES THAT ARE NOT EXPRESSLY PROVIDED IN THESE TERMS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH DISCLAIMERS ARE PERMITTED BY LAW.
WE DO NOT WARRANT THAT CAPZA WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR THAT ANY PARTICULAR RECORD, ESTIMATE, REPORT, OR OUTPUT WILL BE COMPLETE OR ACCURATE.
Nothing in these Terms excludes or limits rights or warranties that cannot legally be waived.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEVEL UP RESIDENTIAL LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITY, GOODWILL, OR DATA, ARISING OUT OF OR RELATING TO CAPZA OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF LEVEL UP RESIDENTIAL LLC ARISING OUT OF OR RELATING TO CAPZA OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO LEVEL UP RESIDENTIAL LLC FOR CAPZA DURING THE 12 MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100.
These limitations do not apply to liability that cannot be limited under applicable law. Nothing in these Terms limits liability to the extent a limitation would be unenforceable because of fraud, willful misconduct, gross negligence, or a nonwaivable statutory right.
Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, these provisions apply only to the maximum extent permitted by law.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Level Up Residential LLC and its officers, employees, contractors, and service providers from third-party claims, damages, liabilities, losses, and reasonable costs arising from: (a) User Content you submit in violation of law or another person's rights; (b) your unauthorized or unlawful use of Capza; (c) your infringement or violation of a third party's rights; or (d) your material breach of these Terms.
This section does not require you to indemnify any person for that person's own fraud, willful misconduct, gross negligence, or other liability that cannot lawfully be shifted to you.
These Terms and any dispute arising out of or relating to Capza are governed by applicable federal law and, to the extent not preempted, the laws of the State of New York, without regard to conflict-of-law rules.
This choice of law does not deprive you of mandatory consumer protections of the state in which you live that cannot legally be waived by contract.
Before filing a formal claim, we encourage you to contact us so we can try to resolve the issue. This is not a mandatory arbitration requirement and does not prevent either party from seeking relief when appropriate.
Except where applicable law requires another forum, any action arising out of or relating to these Terms or Capza must be brought in a state court located in Queens County, New York, or in the United States District Court for the Eastern District of New York, and you and Level Up Residential LLC consent to the personal jurisdiction of those courts.
Either party may bring an eligible individual claim in small claims court where jurisdiction and venue are proper.
These Terms do not require arbitration and do not contain a class-action waiver.
We may update these Terms as Capza or applicable law changes. If a change materially affects your rights or an ongoing paid subscription, we will provide notice and obtain additional consent where required by law.
The version and effective date displayed at the top identify the Terms currently in effect.
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect to the extent permitted by law.
Our failure to enforce a provision is not a waiver of that provision.
You may not assign your account or these Terms without our consent. We may assign these Terms in connection with a merger, reorganization, sale of assets, financing, or transfer of the Capza business, subject to applicable law.
These Terms, together with the Privacy Policy and any subscription terms presented at purchase, constitute the agreement between you and Level Up Residential LLC concerning Capza, except for any separate written agreement that expressly applies.
